Terms of Service

Plain-language summary: By using Pressend, you agree to these terms. They cover how you may use our payment services, what we're responsible for, and what happens if something goes wrong. We've written this to be readable — but the full legal text below governs. If you disagree with any part, please don't use Pressend.

Section 01

Definitions

In these Terms, the following words have the meanings set out below unless the context requires otherwise. Understanding these definitions is essential to reading the rest of this document correctly.

"Pressend", "we", "our", "us"Pressend Solutions., a Nigerian Business corporation, and its subsidiaries and affiliates operating the Pressend platform in Nigeria.
"Services"All products, features, and functionality provided by Pressend including NFC Payments, Face Pay, Palm Pay, Panic Account, and Posthumous Configuration.
"Account"Your registered user account on the Pressend platform, through which you access the Services.
"Transaction"Any transfer, payment, receipt, or movement of funds initiated or processed through the Pressend platform.
"Biometric Data"Facial geometry, palmprint vein patterns, or fingerprint templates captured and processed by Pressend's authentication systems.
"Panic Mode"The emergency feature activated by a pre-configured secondary PIN that triggers a silent alert and displays a declined payment screen.
"Posthumous Config"The feature allowing you to designate beneficiaries for fund distribution following a defined inactivity period.
"User Content"Any information, data, or material you provide to Pressend, including but not limited to profile details, transaction notes, and beneficiary information.
Section 02

Eligibility

To use Pressend, you must meet all of the following requirements at all times during your use of the Services:

  • You must be at least 18 years of age, or the age of majority in your jurisdiction if higher.
  • You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
  • You must not be a resident of, or located in, any country subject to comprehensive trade sanctions by the United States, United Kingdom, European Union, or United Nations.
  • You must not have previously had a Pressend account terminated for cause by Pressend.
  • You must not be identified on any governmental list of prohibited or restricted parties.
  • If registering on behalf of a business, you must have full authority to bind that business to these Terms.
Age Verification

We may require identity verification at any time to confirm eligibility. Providing false information about your age or identity is a material breach of these Terms and may result in immediate account termination and referral to relevant authorities.

Section 03

Account Registration & Security

When you create a Pressend account, you agree to provide accurate, current, and complete information and to keep that information updated. You are solely responsible for maintaining the confidentiality of your credentials.

Your Responsibilities
  • Keep your PIN, password, and Panic PIN strictly confidential and do not share them with any other person.
  • Notify Pressend immediately at security@Pressend.app if you suspect any unauthorised access to your account.
  • Ensure your registered device and biometric data are kept secure. You are responsible for all activity on your account.
  • You may not create more than one personal Pressend account without our express written permission.
Account Verification

Pressend uses Know Your Customer (KYC) processes in compliance with applicable anti-money laundering regulations. We may ask for government-issued ID, proof of address, or additional information at any time. We reserve the right to suspend your account pending verification and to close accounts that fail verification.

Two-Factor Authentication

We strongly recommend enabling all available authentication methods. Transactions exceeding ₦1,000,000 equivalent automatically require biometric re-authentication regardless of your settings. This cannot be disabled.

Section 04

Payment Services

Pressend provides a range of payment and financial transfer services. By using these services, you acknowledge and agree to the following conditions.

Transaction Finality

All Transactions processed through Pressend are final and irreversible once confirmed, except where Pressend's dispute resolution process applies. You are solely responsible for verifying that you are sending funds to the correct recipient and in the correct amount before authorising any Transaction.

Limits may be increased upon successful completion of enhanced verification. Verified business accounts have separate limits outlined in the Merchant Agreement.

Authorisation & Settlement

By initiating any Transaction, you unconditionally authorise Pressend to debit your account and credit the recipient in the specified amount. We reserve the right to decline any Transaction at our sole discretion, including for suspected fraud, sanctions compliance, or system capacity reasons. A declined Transaction will not be charged.

Section 07

Panic Account

The Panic Account is a safety feature. Its use, configuration, and limitations are governed by the following terms.

  • Panic Mode is activated by entering a secondary PIN designated by you in Settings. You are solely responsible for configuring and securing this PIN.
  • When Panic Mode is activated, Pressend will display a simulated Transaction decline to the third-party at the payment terminal. No funds are transferred during a Panic Mode session.
  • Pressend will transmit a discreet push notification to your designated emergency contacts and, where enabled, your current GPS coordinates.
  • Pressend is not a law enforcement or emergency service provider. Panic Mode is a supplementary safety measure and does not replace calling emergency services where available.
  • Pressend accepts no liability for outcomes resulting from Panic Mode activation, including but not limited to situations where alerts fail to reach contacts due to connectivity issues.
  • Deliberate false activation of Panic Mode (e.g. as a prank) is a violation of these Terms and may result in account suspension.
Emergency Disclaimer

If you are in immediate danger, call your local emergency number first. Panic Mode is designed to supplement, not replace, emergency services. Pressend cannot guarantee alert delivery times or response from contacts.

Section 08

Posthumous Configuration

Posthumous Configuration allows you to pre-designate beneficiaries to receive your Pressend balance following a defined period of account inactivity. This feature involves sensitive legal and financial considerations.

How It Works
  • You may designate up to 10 beneficiaries and assign percentage allocations totalling 100%.
  • You must specify an inactivity threshold of between 180 days and 5 years.
  • Pressend will send graduated check-in notifications at 30, 14, 7, and 1 day before the threshold is reached.
  • Responding to any check-in notification — or any account activity — resets the inactivity clock.
  • Upon threshold expiry, Pressend initiates a beneficiary verification process. No funds are disbursed until all required documentation is verified.
Legal Considerations

Posthumous Configuration is a financial planning convenience feature, not a substitute for a legally valid will or estate plan. Designations made in Pressend may conflict with your will, probate law, or applicable inheritance regulations in your jurisdiction. We strongly recommend consulting a licensed legal professional before configuring this feature. Pressend is not responsible for tax implications arising from fund disbursements.

Beneficiary Verification

All beneficiaries must complete Pressend's identity verification process before funds are disbursed. Beneficiaries have a 12-month claim window from notification. Unclaimed funds are held in secure escrow for a further 5 years before being transferred to a designated charitable foundation unless otherwise required by law.

Modification Rights

You may modify or revoke your Posthumous Configuration at any time while your account is active. Modifications take effect immediately. Pressend will confirm all changes by email to your registered address.

Section 09

Fees & Charges

Pressend's consumer services are provided under the following fee structure. All fees are displayed in-app before any transaction is completed and are inclusive of applicable taxes where we are required to collect them.

We reserve the right to introduce new fees with 30 days' advance notice by email and in-app notification. Continued use of the Services after the notice period constitutes acceptance of updated fees.

Section 10

Prohibited Uses

You may not use Pressend for any of the following purposes. Violation of these prohibitions will result in immediate account termination, forfeiture of funds pending investigation, and may result in civil or criminal referral.

  • Money laundering, terrorist financing, or any activity that violates applicable AML laws.
  • Purchasing, selling, or transferring value for illegal goods or services including narcotics, weapons, or counterfeit items.
  • Fraudulent chargebacks, false dispute claims, or any attempt to obtain goods or services without legitimate payment.
  • Deliberately spoofing biometric authentication using artificial means.
  • Reverse engineering, decompiling, or attempting to extract source code from the Pressend application or API.
  • Using automated bots, scripts, or other means to access the Services in a way that is not authorised by Pressend's API Terms.
  • Deliberately overloading or attempting denial-of-service against any Pressend system or infrastructure.
Section 11

Intellectual Property

All intellectual property in the Pressend platform — including but not limited to the software, algorithms, UI designs, trademarks, trade names, logos, and documentation — is the exclusive property of Pressend Solutions Inc. or its licensors. Nothing in these Terms grants you any intellectual property rights beyond the limited licence to use the Services described herein.

You grant Pressend a non-exclusive, royalty-free, worldwide licence to use, process, and display your User Content solely for the purpose of providing the Services. This licence is limited to what is operationally necessary and does not permit Pressend to sell your User Content to third parties.

Section 12

Limitation of Liability

To the maximum extent permitted by applicable law, Pressend's liability to you for any claims arising from your use of the Services is limited as follows:

  • Pressend's aggregate liability to you for any claim shall not exceed the total fees you paid to Pressend in the 12 months preceding the event giving rise to the claim.
  • Pressend is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
  • Pressend is not liable for any losses resulting from your own negligence, failure to secure your credentials, or use of the Services contrary to these Terms.
  • Pressend is not liable for failures caused by third-party service providers, telecommunications failures, acts of God, or circumstances outside our reasonable control.
Fraud Protection

Notwithstanding the above, where a Transaction is found to be the result of fraud that occurred through no fault of your own, Pressend will investigate and where confirmed, reimburse the Transaction amount. This does not limit our ability to seek recovery from the fraudulent party.

Section 13

Disputes & Governing Law

These Terms are governed by the laws of the Nigerian Government, without regard to conflict of law principles.

Dispute Resolution Process
  • Step 1: Contact our support team at hello@Pressend.app. Most disputes are resolved within 5 business days.
  • Step 2: If unresolved, escalate to our formal dispute process at disputes@Pressend.app. We will respond with a resolution proposal within 14 days.
  • Step 3: If you remain unsatisfied, you may pursue arbitration under the rules of the American Arbitration Association on an individual basis.
  • Class action waiver: You agree to resolve disputes with Pressend on an individual basis and waive your right to participate in any class action lawsuit or class-wide arbitration.
Section 14

Termination

Either party may terminate the relationship under these Terms at any time. The following applies in each scenario:

Termination by You

You may close your Pressend account at any time through the app's Settings menu. Upon closure, your biometric data and personal information will be deleted within 30 days (subject to legal retention obligations). Any positive balance will be returned to your nominated bank account within 10 business days. Posthumous Configuration designations are automatically cancelled.

Termination by Pressend

Pressend may suspend or terminate your account immediately without notice for violations of these Terms, suspected fraud, regulatory requirements, or as required by law. In cases of termination for cause, we will retain funds pending investigation. Where termination is for reasons unrelated to your conduct, we will provide 30 days' notice and return your balance.

Section 15

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will:

  • Send you an email notification to your registered address at least 30 days before the changes take effect.
  • Display a prominent in-app banner highlighting the key changes.
  • Publish a changelog on our website summarising what changed and why.
  • Require explicit re-acceptance for changes that materially affect your rights or obligations.

Continued use of Pressend after the effective date of updated Terms constitutes acceptance. If you do not agree with the changes, you must close your account before the effective date.
